Tri State Enforcement Regional Authority Communications Policy

1. Agreement
You agree to the terms and conditions outlined in this Communications Policy Agreement (the “Agreement”) with respect to this website, Tri State Enforcement Regional Authority (“We” “Us” or “Our”), and any communications involving Us, without regard for who initiates the communication. This Agreement constitutes the entire and only agreement between You and Us regarding communications, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with regards to communications involving You and Us, and any form of communication which occur between You and Us, with the exception of that which has been agreed upon between You and Us as detailed within a duly executed Service Contract Agreement (“SCA”). All communications by and from Tri State Enforcement Regional Authority are confidential and proprietary, may contain restricted or sensitive information, and shall be treated as such regardless of label or definition.
2. Consent
By communicating with Us, You give consent to the following terms and conditions of this Agreement: (i) any and all phone calls initiated by You or Us may be monitored and/or recorded by Us at any time, with or without notice or notification; (ii) any in-person meetings, conferences, workshops, speaking engagements, or other in-person methods of communication may be audio and/or video recorded with or without prior notice, unless otherwise prohibited by state or federal law; (iii) any interaction with employees or representatives of this Agency which occurs in person may be audio and video recorded by any number of devices, including Body Worn Camera, in accordance with Our policies and applicable laws in the jurisdiction where such recording occurs; (iv) any web-based, electronic, data-based, or internet-based communications will be subject to the logging, extraction, recording, or identifying of information including but not limited to time, date, IP address, unique identifiers of the device used, operating system, geo-location, and similar; (v) any information or audio or video recordings may be retained by Us for any duration We deem necessary, and used for any lawful purpose We deem necessary. Your sole remedy if You do not consent is to no longer communicate with Us, unless You are under a contractual or financial obligation with Us, whereby any and all contractual and financial obligations must be satisfied prior to You terminating communication with Us.
3. Privacy
In addition to the terms of this Agreement, Our policy regarding the collection and use of Your personal information is set forth in more detail in our Privacy Policy. However, We reiterate herein that the security of Your personal information is important to Us. We follow generally accepted industry standards and best practices to protect all personal information submitted to Us. For more information regarding privacy, please review Our Privacy Policy.
4. Electronic Communications
We use reasonable efforts in the preparation and subsequent dissemination of information and material to all persons and entities with whom We communicate. We cannot, however, warrant all information is complete, accurate, or error-free. Information We compile, review, and disseminate may contain inaccuracies, typographical errors, and similar. Further, electronic communications in general cannot be guaranteed to be secure or error-free. Electronic communications could be intercepted, hacked, corrupted, lost, destroyed, arrive late or incomplete, or contain viruses, malware, spyware, or ransomware.
Any form of electronic communications transmitted to or from Tri State Enforcement Regional Authority is protected under United States Code, Title 18, § 2510-22. Communications originating from Us, which include any and all information or attachments thereto are intended exclusively for the individual(s) or the entity to which they are addressed, or a duly authorized agent responsible and authorized for such delivery. Electronic communications may contain proprietary, confidential, restricted, or privileged information, prohibited from unauthorized disclosure under federal law. Any individual or entity who is not the named addressee or authorized agent thereof, is prohibited by law from: dissemination, archival, printing, copying, distribution, or retention of any such message, or attachments thereto. Doing so may result in criminal and civil penalties under federal law.
Any recipient receiving any Electronic Communication in error should immediately notify the sender of unintended, accidental, or erroneous receipt; and permanently delete any such communication and any attachments received from their system. Electronic transmissions cannot be guaranteed to be secure or error-free. Tri State Enforcement Regional Authority and its employees, agents, representatives, contractors, officers, successors, and assigns disclaim all liability resulting from any errors, content, attachments, or omissions in connection with electronic communications. If verification of any electronic communication is required, please request a hard-copy version from the sender. The cost for any hard-copy verification is $45.00 per request and $0.50 per page.
5. Internal Communications
In accordance with policy and law, all communications occurring internally are subject to audio and video recording. All employees, agents, vendors, partners, and contractors are subject to audio and video recording during any communication, conversation, phone call, and similar, when such communication is involving or pertains to the business, operations, or interests of Tri State Enforcement Regional Authority.
6. Disclaimer of Warranty and Liabilities
We give no warranty that communications involving Us will be uninterrupted or error free; or that communications with Us shall be free of errors, inaccuracies, omissions, and similar. You hereby acknowledge that phone and email is not a 100% reliable or secure mode of communication. There may be times where you do not receive a phone or email communication from Us when expected. You agree that phone and email services are provided as a convenience. If You do not receive any expected communication, You agree that it is your responsibility to check any spam filters or folders under your email, and call logs and voice mail under your phone system or device. Tri State Enforcement Regional is not responsible if You fail to receive any specific communication for any reason. Further, we will not be liable for any loss of data or information provided through email.
We disclaim any and all liability to any individual, organization or other entity for any loss or damage which may arise from communications with Us whether caused by errors or omissions, misinformation, inaccuracies, typographical errors, data that has been corrupted, lost, destroyed, that arrives late or incomplete, that may contain viruses, malware, or spyware, contained in, or associated with Us, Our website, phone calls, emails, and any other method of communication with Us, and without regard if any such issue arise from negligence, accident or any other cause.
