The protection and security of our nation’s critical infrastructure, including the chemical sector; is critical to the continued health, safety, continuity, and economy of our nation. Each day across the United States, thousands of businesses and facilities produce, manufacture, store, transport, receive, and utilize dangerous and hazardous chemicals and compounds. In the last few decades, significant efforts have been made, both by those involved in the industry, as well as legislators; seeking to enhance the safety, security, and resilience of the chemical sector. The primary focus of efforts have been risk mitigation—prevention of dangerous and hazardous chemicals being illicitly acquired for the purpose of weaponizing.

A cornerstone of modern efforts have involved chemical facility operators and stakeholders adhering to federal regulations, sector collaboration, and ensuring proper processes are implemented regarding protection and security. Today, more than ever before, virtually every industry faces increased threats and risks. With mounting discord both nationally and globally involving the United States, the reality of a criminal or terroristic act a very real concern. Chemical facilities must not only plan for; but must be capable of responding to, and mitigating against incidents of physical attacks, sabotage, cyber threats, insider threats, espionage, theft, diversion, disgruntled employees, and workplace violence.

Federal Regulations & Chemical Facility Anti-Terrorism Standards (CFATS)

Under the Code of Federal Regulations (CFR), facilities which possess, store, produce, manufacture, or utilize one or more of 300 identified Chemicals of Interest (COI); are likely Department of Homeland Security (DHS) designated facilities which are regulated under 6 CFR 27. Under this regulation, the Chemical Facility Anti-Terrorism Standards exist, which were developed in 2007, and have been incrementally updated since being codified. DHS oversees chemical sector facilities which have been designated under CFATS through it’s Cybersecurity & Infrastructure Security Agency (CISA).

Under the Code of Federal Regulations (CFR), facilities which possess, store, produce, manufacture, or utilize specific Chemicals of Interest (COI); are likely Department of Homeland Security (DHS) designated facilities which are regulated under 6 CFR 27. Under this regulation, the Chemical Facility Anti-Terrorism Standards exist, which were developed in 2007, and have been incrementally updated since being codified. CFATS was the first federal regulatory program with the sole focus on the security and safeguarding of high-risk chemicals, and the facilities where such chemicals are made, used, stored, or transported.
